OSHA PSM 1910.119(p) is the disclosure element of the standard, and it makes a simple but important point. You must make all the information needed to comply with paragraphs (a) through (o) available to the people who actually use it, which means those who compile the process safety information, those who help with the process hazard analyses, those who write the operating procedures, and those who carry out incident investigations, emergency planning, and compliance audits, and you must do this regardless of any trade secret status the information may carry. Paragraph (p)(2) gives employees and their designated representatives a right to access trade secret information under the conditions set out in 29 CFR 1910.1200(i)(1) of the OSHA Hazard Communication Standard.
